Privacy Policy of SportPesa (Pty) Ltd

THIS PRIVACY POLICY FORMS PART OF SPORTPESA’S TERMS AND CONDITIONS. IT EXPLAINS HOW SPORTPESA COLLECTS, USES, STORES, SHARES, PROTECTS, AND OTHERWISE PROCESSES PERSONAL INFORMATION WHEN YOU ACCESS OR USE SPORTPESA’S WEBSITE, MOBILE APPLICATION, USSD, OTHER APPROVED CHANNELS, AND SERVICES.

IF YOU DO NOT AGREE WITH THIS PRIVACY POLICY, YOU SHOULD NOT ACCESS OR USE SPORTPESA’S CHANNELS OR SERVICES.

1. About This Policy

1.1. SportPesa respects your privacy and recognises the importance of protecting your Personal Information. This Privacy Policy describes SportPesa’s information gathering, processing, sharing, retention, and security practices.

1.2. This Privacy Policy applies to Personal Information collected or processed through SportPesa’s Website, Mobile Application, USSD, customer support channels, retail or other approved channels, and any other platform or service used by SportPesa to interact with you.

1.3. This Privacy Policy must be read together with SportPesa’s Terms and Conditions, betting rules, product rules, promotional terms, Cookies Policy, and any other terms or notices made available by SportPesa from time to time.

1.4. SportPesa may amend this Privacy Policy from time to time. Where material changes are made, SportPesa will take reasonable steps to notify you through the Website, Mobile Application, email, SMS, or any other appropriate communication channel. Where required by law, SportPesa may request your consent before applying material changes to the way your Personal Information is processed.

1.5. Your continued use of the Channels or Services after notice of an updated Privacy Policy will constitute acknowledgement of the updated Privacy Policy, unless separate consent is required by law.

2. Who Are We

2.1. “SportPesa”, “we”, “us” or “our” means SportPesa, a private company registered in accordance with the laws of South Africa with registration number 2015/321094/07 and located at The Boulevard Office Park, Searle Street, Woodstock, Cape Town, 7925.

2.2. “You”, “your”, “Customer” or “user” means any person who accesses the Channels, registers an Account, uses the Services, communicates with SportPesa, or enters into an Agreement with SportPesa.

3. Definition and Interpretation

In this Privacy Policy, the following words have the meanings set out below:

3.1. “Agreement” means any agreement between SportPesa and you for the provision of services.

3.2. “Mobile Application” means the mobile application made available by SportPesa to provide the Services.

3.3. “Personal Information” means information relating to an identifiable, living natural person and, where applicable, an identifiable juristic person, as more fully defined in POPIA.

3.4. “Channels” refers to the Website and the Mobile Application together, as well as USSD and any other digital platform that SportPesa uses to interact with you. We may still refer to them separately if it is necessary to treat them differently.

3.5. “POPIA” means the Protection of Personal Information Act 4 of 2013.

3.6. “Process” or “Processing” means any operation or activity concerning Personal Information, including collecting, receiving, recording, organising, storing, updating, retrieving, using, sharing, distributing, restricting, erasing, or destroying Personal Information, as more fully defined in POPIA.

3.7. “Services” means the services provided by SportPesa to you, including betting, account management, customer support, promotions, payment processing, and related services.

3.8. “Website” means SportPesa’s website at www.Sportpesa.co.za (including subdomains) or such other URL as SportPesa may choose from time to time.

4. Collection of Personal Information

4.1. When you access the Channels, register an Account, or use the Services, SportPesa collects and processes Personal Information about you. This may include information collected directly from you, information generated through your use of the Services, and information received from third parties where permitted or required by law.

4.2. SportPesa will only collect Personal Information that is reasonably necessary for the purposes described in this Privacy Policy, or as otherwise permitted or required by law.

4.3. Certain Personal Information is required in order for SportPesa to provide the Services and comply with applicable laws and regulatory requirements, including gambling, financial intelligence, anti-money laundering, fraud prevention, responsible gambling, tax, and data protection requirements. If you do not provide the required Personal Information, SportPesa may not be able to register or maintain your Account, process payments, verify your identity, provide access to the Services, or comply with its legal and regulatory obligations.

4.4. Personal Information collected by SportPesa may include, where applicable:
(a) Name and surname;
(b) Date of birth;
(c) Gender;
(d) nationality, identity number, passport number, age-verification information, and identity-verification information;
(e) mobile number, email address, residential address, and other contact details;
(f) Account registration details, login details, customer number, username, and account profile information;
(g) FICA, KYC, identity-verification, proof of address, and due diligence documents;
(h) betting activity, gaming history, account balances, winnings, losses, reversals, adjustments, account limits, account restrictions, and product usage information;
(i) responsible gambling information, including account limits, cooling-off periods, self-exclusion information, affordability-related information, risk indicators, and responsible gambling interactions;
(j) source of funds, source of wealth, affordability, or related information where required for anti-money laundering, fraud prevention, responsible gambling, or regulatory compliance purposes;
(k) technical information, including IP address, device information, browser information, operating system, location-related information, network information, cookies, analytics information, and information about how you access and use the Channels; and
(l) any other information reasonably required for the purposes described in this Privacy Policy or required by applicable law, license conditions, regulatory requirements, or SportPesa’s internal compliance procedures.

4.5. SportPesa may collect Personal Information from you directly, from your use of the Channels and Services, from payment service providers, identity verification providers, fraud prevention providers, credit bureau, banks, regulatory authorities, responsible gambling bodies, law enforcement agencies, publicly available sources, and other third parties where permitted or required by law.

4.6. SportPesa processes Personal Information where it has a lawful basis to do so, including where processing is necessary to provide the Services, perform the Agreement, comply with legal and regulatory obligations, prevent fraud and money laundering, support responsible gambling, protect SportPesa’s rights, or where you have provided consent.

4.7. If your Personal Information changes at any point, you must update your Account details or contact SportPesa as soon as possible to ensure that your information remains accurate and up to date.

5. Processing of Personal Information

5.1. SportPesa will process Personal Information in a manner that is adequate, relevant, and not excessive in relation to the purpose for which it is processed. SportPesa will process Personal Information for purposes that are compatible with the purpose for which the information was collected, unless you have consented to another purpose or SportPesa is permitted or required to do so by law.

5.2. SportPesa may process Personal Information for the following purposes:
(a) to register, verify, manage, and administer your Account;
(b) to provide access to the Channels and Services;
(c) to verify your identity, age, address, payment method, and eligibility to use the Services;
(d) to process deposits, withdrawals, Bets, refunds, reversals, chargebacks, and other account transactions;
(e) to comply with gambling, anti-money laundering, financial intelligence, tax, consumer protection, data protection, and other applicable legal or regulatory obligations;
(f) to prevent, detect, investigate, and report fraud, money laundering, terrorist financing, proliferation financing, cheating, collusion, bonus abuse, unauthorised account use, and other unlawful or prohibited activity;
(g) to monitor and manage responsible gambling risks, including account limits, self-exclusion, cooling-off, affordability, and harmful gambling indicators;
(h) to verify source of funds, source of wealth, payment method ownership, and other due diligence information where required;
(i) to communicate with you about your Account, transactions, disputes, complaints, changes to the Services, security issues, regulatory matters, and customer support queries;
(j) to improve, personalise, test, monitor, secure, and maintain the Channels and Services;
(k) to conduct research, analytics, auditing, reporting, and business administration;
(l) to enforce SportPesa’s Terms and Conditions, betting rules, promotional terms, product rules, and internal policies;
(m) to exercise or defend legal rights, recover amounts owed, resolve disputes, and respond to legal or regulatory processes; and
(n) to send marketing communications where permitted by law and subject to your marketing preferences.

5.3. SportPesa may use automated systems and automated processing to detect fraud, comply with legal and regulatory obligations, monitor responsible gambling risks, verify identity and payment information, assess account activity, personalise the Services, and identify suspicious or irregular activity. Automated processing may affect access to certain Services, withdrawals, account restrictions, responsible gambling controls, or account reviews. You may request further information or ask SportPesa to review a decision, subject to applicable law and regulatory requirements.

5.4. SportPesa may process special personal information, including biometric information where used for identity verification, only where permitted by law, where necessary to comply with legal or regulatory obligations, where required for fraud prevention or account security, or where you have provided consent where required. SportPesa may also process financial information, payment information, and due diligence information where necessary for the Services, fraud prevention, anti-money laundering, responsible gambling, or regulatory compliance purposes.

5.5. The Services are not intended for persons under the age of 18. SportPesa may process Personal Information to verify your age and identity. If SportPesa becomes aware that a minor has attempted to register, has registered, or has provided Personal Information, SportPesa may refuse registration, restrict or close the Account, and delete the information unless SportPesa is required or permitted to retain it for legal, regulatory, fraud prevention, or record-keeping purposes.

5.6. As SportPesa develops its business, it may sell, buy, transfer, merge, restructure, or reorganise all or part of its business or assets. In such circumstances, Personal Information may be transferred as part of the relevant transaction, provided that such transfer is lawful and subject to appropriate safeguards.

6. Retention, Destruction and De-identification of Personal Information

6.1. You may request the deletion or destruction of your Personal Information. SportPesa will consider such request in accordance with POPIA and applicable law.

6.2. SportPesa may retain Personal Information where required or permitted for legal, regulatory, gambling, anti-money laundering, tax, accounting, audit, fraud prevention, responsible gambling, dispute resolution, security, operational, or record-keeping purposes.

6.3. Where Personal Information is no longer required for the purpose for which it was collected or subsequently processed, and SportPesa is not legally required or permitted to retain it, SportPesa will delete, destroy, or de-identify such information.

6.4. Information relating to deleted, closed, suspended, restricted, self-excluded, or dormant Accounts may be retained where required or permitted to comply with law, prevent fraud, resolve disputes, monitor responsible gambling obligations, comply with regulatory requirements, or enforce SportPesa’s Terms and Conditions.

7. Your Rights

7.1. In terms of POPIA, you may have the right to:
(a) request access to your Personal Information;
(b) request correction or deletion of your Personal Information;
(c) object to the processing of your Personal Information in certain circumstances;
(d) withdraw consent where processing is based on consent;
(e) request proof of authorisation where your Personal Information has been shared with a third party, where applicable; and
(f) lodge a complaint with the Information Regulator.

7.2. SportPesa may require proof of identity before giving effect to any request relating to Personal Information.

7.3. You may exercise your rights by contacting SportPesa at support@sportpesa.co.za or through the privacy or Information Officer contact details made available by SportPesa from time to time.

7.4. You may lodge a complaint with the Information Regulator using the contact details published by the Information Regulator from time to time.

8. Cookies and Similar Technologies

8.1. SportPesa may use cookies and similar technologies to operate the Channels, improve user experience, analyse usage, secure the Services, prevent fraud, remember user preferences, and support advertising or marketing activities where permitted by law.

8.2. Further information may be made available in SportPesa’s Cookies Policy, where published.

8.3. You may be able to manage certain cookie preferences through your browser settings or through any cookie preference tools made available by SportPesa. Disabling certain cookies may affect the functionality of the Channels or Services.

9. Security

9.1. SportPesa will secure the integrity and confidentiality of Personal Information in its possession or under its control by taking appropriate, reasonable technical and organisational measures to prevent:
(a) loss of, damage to, or unauthorised destruction of Personal Information; and
(b) unlawful access to or processing of Personal Information.

9.2. SportPesa will take reasonable measures to:
(a) identify reasonably foreseeable internal and external risks to Personal Information in its possession or under its control;
(b) establish and maintain appropriate safeguards against the risks identified;
(c) regularly verify that the safeguards are effectively implemented; and
(d) ensure that the safeguards are continually updated in response to new risks or deficiencies in previously implemented safeguards.

9.3. Although SportPesa takes reasonable steps to protect Personal Information, no data transmission or storage system can be guaranteed to be completely secure. Any transmission of information through the internet or electronic channels is done at your own risk.

9.4. If SportPesa becomes aware of a security compromise involving Personal Information, SportPesa will take reasonable steps to assess, contain, and address the compromise and will notify the Information Regulator and affected data subjects where required by POPIA.

10. Links to Other Websites

10.1. The Channels may contain links to third-party websites, platforms, products, or services. SportPesa does not control and is not responsible for the privacy practices, security measures, content, or services of third parties.

10.2. You should review the privacy policy and terms of any third-party website, platform, product, or service before using it or providing Personal Information to that third party.

11. Unsolicited Information and Public Forums

11.1. Please do not send SportPesa unsolicited Personal Information that is not required for the Services. If SportPesa receives unsolicited Personal Information that it is not required or permitted to retain, SportPesa will take reasonable steps to delete, destroy, or de-identify it.

11.2. You are responsible for any information, including Personal Information, that you publish publicly or make available to others, including through any public forum, social media platform, or interactive feature. SportPesa is not responsible for any third-party access to or use of information that you make publicly available.

12. Aggregated, Anonymised and De-identified Information

12.1. SportPesa may use aggregated, anonymised, or de-identified information for research, analytics, reporting, advertising, business development, regulatory reporting, product improvement, and other lawful purposes.

12.2. Aggregated, anonymised, or de-identified information does not identify you personally.

12.3. SportPesa may share aggregated, anonymised, or de-identified information with affiliates, agents, service providers, business partners, advertisers, regulators, or other third parties for lawful purposes.

13. Marketing and Advertising

13.1. SportPesa may use your Personal Information to send you marketing communications about products, services, promotions, offers, campaigns, or features where permitted by law.

13.2. Where required, SportPesa will obtain your consent before sending direct marketing communications.

13.3. Each marketing communication will include a reasonable opportunity to opt out, and you may update your marketing preferences or opt out of marketing communications at any time.

13.4. SportPesa may use aggregated, anonymised, or de-identified information for advertising, analytics, research, reporting, and business purposes. This information will not identify you personally.

14. Foreign Data Protection Rights

14.1. SportPesa operates primarily in South Africa and processes Personal Information in accordance with POPIA and other applicable South African laws.

14.2. Where any foreign data protection law applies to SportPesa’s processing of Personal Information, SportPesa will process such Personal Information in accordance with applicable legal requirements.

15. Sharing and Transfer of Personal Information

15.1. SportPesa may share Personal Information with employees, affiliates, group companies, service providers, operators, agents, contractors, professional advisers, auditors, payment service providers, banks, payment intermediaries, identity verification providers, fraud prevention providers, credit bureau, IT and cloud hosting providers, responsible gambling service providers, gambling regulators, the National Gambling Board, provincial licensing authorities, the Financial Intelligence Centre, the South African Revenue Service, law enforcement agencies, courts, and other competent authorities where required or permitted for the purposes described in this Privacy Policy.

15.2. SportPesa may share Personal Information where necessary to:
(a) provide the Services;
(b) verify identity, age, address, payment method ownership, source of funds, or source of wealth;
(c) process payments, withdrawals, refunds, chargebacks, reversals, or adjustments;
(d) detect, prevent, investigate, or report fraud, money laundering, terrorist financing, proliferation financing, cheating, collusion, bonus abuse, unauthorised account use, or other unlawful or prohibited activity;
(e) monitor, manage, or report responsible gambling risks, exclusions, restrictions, or interventions;
(f) comply with gambling, financial intelligence, tax, consumer protection, data protection, and other legal or regulatory obligations;
(g) respond to court orders, subpoenas, regulatory notices, lawful requests, investigations, audits, or inspections;
(h) protect SportPesa’s rights, property, systems, customers, employees, service providers, or the public; or
(i) enforce SportPesa’s Terms and Conditions, betting rules, promotional terms, product rules, and internal policies.

15.3. SportPesa operates its Channels from the Republic of South Africa. If you access the Channels or Services from outside South Africa, you acknowledge that your Personal Information may be transferred to and processed in South Africa.

15.4. SportPesa may use hosting, cloud, technology, payment, verification, support, or other service providers located outside South Africa. Where Personal Information is transferred outside South Africa, SportPesa will take reasonable steps to ensure that the transfer complies with POPIA and that appropriate safeguards are in place, including by using contractual safeguards or service providers located in countries with adequate data protection laws, where applicable.

16. Accuracy of Personal Information

16.1. You are responsible for ensuring that the Personal Information you provide to SportPesa is accurate, complete, and up to date.

16.2. SportPesa may take reasonable steps to verify the accuracy of Personal Information, including by requesting additional documents or information from you or from third-party verification providers.

16.3. SportPesa may restrict, suspend, or close an Account, delay or decline transactions, or refuse access to the Services where Personal Information is inaccurate, incomplete, outdated, false, misleading, or cannot be verified.
